Manfredonia, 19 June 2024. Operation “Hands off”: as anticipated, the notices of conclusion of the preliminary investigations relating to the investigation by the Public Prosecutor’s Office of Foggia have been served which last March 9th had led to the execution by the financiers of the Company of Manfredoniaof precautionary measures against 7 suspects, including entrepreneurs, professionals and some public officials currently or in the past in service in the Siponto municipality and a subsidiary company.

As reported, the investigations of the “Hands off” operation, launched in February 2022, followed three related linesthe first, to alleged intimidation carried out by two employees of a municipal company to the detriment of colleagues and the hypothesis of embezzlement of company assets, the second, to the circumvention of an anti-mafia prohibition established by the Prefecture of Foggia in the exercise of activities of funeral directors and the third to pressure the municipal apparatus to avoid the dismantling of an illegal restaurant on the Manfredonia coast.

Now, following the execution of personal precautionary measures, the Court of Review had changed the restrictive measures against some investigated and reclassified some disputed crimes.

Notify notices of conclusion of investigations, names

Since 17 June 2024, from data collection by StatoQuotidiano.it, notices of the conclusion of the investigations have been served against the aforementioned and further suspects, accused in various capacities of embezzlement, extortion, corruption, forgery of certificates or administrative authorisations, extortion, threats, stalking, aggravated personal injury and private violence.

The Prosecutor, Dr. Roberto Gallideputy public prosecutor at the Court of Foggia (currently “under protection” by the soldiers of the Guardia di Finanza, Company of Manfredonia), with a provision dated 17 June 2024, communicated to the following suspects the notice of conclusion of the preliminary investigations:

• FATONE Michele, born in Manfredonia on 05.09.1961 and resident there, detained in prison for this proceeding.
• FATONE Raffaele, born in Manfredonia on 08.20.1992 and resident there; detained at arrests house arrest for this procedure.
• SALVEMINI Angelo, born in San Giovanni Rotondo (FG) on 9.10.1980 and resident in Manfredonia, detained under arrest at home for this procedure.
• ROMITO Grazia, born in Mattinata on 02.06.1971 and resident in Manfredonia
• ROTOLO Luigi, born in Foggia on 24.9.1976 and resident there
• ROMITO Michele Antonio, born in San Giovanni Rotondo on 04.06.1963 and resident in Manfredonia, detained under house arrest for this proceeding.
• SPAGNUOLO Rocco, born in San Giovanni Rotondo (FG) on 16.3.1970 and resident in Manfredonia (FG)
• GALANTINO Giuliana Maria, born in Trani (BT) on 16.5.1959 and resident in Lucera
• ROTICE John, born in Manfredonia (FG) on 03/29/1967 e there resident
• ROTICE Michele, born in Manfredonia (FG) on 26.2.1958 and resident there;

As regards the new suspects, these are:

• Rocco Spagnuoloborn in San Giovanni Rotondo (FG) on 16.3.1970 and resident in Manfredonia (FG), “held responsible for complicity in embezzlement” (FATONE Michele and SPAGNUOLO Rocco, accused because, in competition with each other, FATONE as a public service representative, as “supervisor” of the staff of the public company ASE spa, with the powers of direction, supervision, control and coordination better indicated to the previous chapter, and SPAGNUOLO as an employee of the same public company appropriated the motor oil better specified in the previous chapter, which they had available due to the role held within the company, FATONE implementing the conduct coercive action against SPAGNUOLO Rocco, described in the previous charge, SPAGNUOLO and delivering to FATONE what he requested)
• Giovanni Roticeborn in Manfredonia (FG) on 03/29/1967 and resident there and Michele Roticeborn in Manfredonia (FG) on 26.2.1958 and resident therefor “competition in the crime of electoral corruption” (for the last two: “since with multiple executive actions of the same criminal plan committed in moral and material competition between them, Rotice Michele and Rotice Giovanni offered or in any case promised Romito Michele Antonio, who accepted the offer or in any case the promise of the Rotices, who in exchange for the electoral vote of Romito, of his family, of his acquaintances and of the commitment made by him to promote and electorally support the victory of Rotice Giovanni in the run-off round of the elections for mayor of the Municipality of Manfredonia, Rotice himself, if he became mayor of the Municipality of Manfredonia, would have allowed or in any case would not have hindered the permanence of the “Guarda Che Luna” structure of the Bar Centrale SaS, of which Romito Michele Antonio was the de facto administrator. In particular, Rotice Michele promoted the illicit electoral agreement between his brother Rotice Giovanni and Romito Michele Antonio, participated in both meetings between the two, organized one of the meetings between them at the headquarters of his company, as well as sealed and guaranteed, through his presence, the handshake confirming the agreement between Rotice Giovanni and Romito Michele Antonio; the latter met in at least two different circumstances to define the terms of the agreement – one in the basement of the Miramare stadium in Manfredonia and the other at the Rotice Michele company – and sanctioned the definitive agreement with a handshake ”)

As specified by the investigators, “it should be noted that the suspects cannot be considered guilty until a final conviction has been pronounced”.
