For the death of Duccio Dini, trial to be redone. The Court of Cassation annulled the 22-year sentence for Kjamuran Amet and Remzi Amet, Dehran Mustafa and Antonio Mustafa accused of the murder of the 29-year-old Florentine, hit and killed by a car involved in a planned chase between ethnic Roma clans for a settlement of accounts, in via Canova on the morning of 10 June 2018. The judges ordered the Ter appeal process for the sole purpose of recalculating the sentence for the four defendants.
Already in March 2023, the Supreme Court had canceled the sentences of up to 25 years and two months inflicted by the Court of Appeal of Florence on four participants in the pursuit of Rufat Bayram, ordering a second appeal trial for the sole redetermination of the sentence , taking into account the mitigating circumstances of article 116 of the penal code. The law provides for a lower sanction for those who, like them, wanted to commit a crime different from the one committed.
With that same sentence, they had become the sentences imposed on Remzi Mustafa, the man who was driving the Volvo, are definitive (25 years’ imprisonment for voluntary manslaughter with possible malice) and others Kole Amet and Emin Gani (7 years for attempted murder) who, aboard a van, had only participated in the initial phase of the pursuit of Rufat Bayram, due to a wheel failure which forced them to stop.
That day Duccio Dini was going to work. He was stopped on his scooter at the traffic lights when he was hit by the Volvo traveling at 100 kilometers per hour. It was innocent victim, the judges reconstructed, of a punitive expedition planned to resolve a feud between ethnic Roma families. What triggered the settling of scores was the oath of loyalty that Bayram imposed on his wife, filmed with his cell phone and then posted on the web.
The gesture provoked the reaction of the woman’s father, Amet Remzi, who attacked his son-in-law. There was an argument between the two, which degenerated. The older one was slapped by Bayram. On the morning of June 10, Antonio Mustafa saw Rufat in the Esselunga car park in via Canova. Without hesitation he called his family members together to carry out revenge. Two cars and a van chased the Zafira driven by Bayram. The crazy race began which, with cars and scooters almost being rammed, ended tragically.
Luca and Beatrice Dini, Duccio’s parents, waited for the verdict in Florence. «We did not participate in the hearing, because as it is a judgment only on the redetermination of the sentence, the civil party has little or nothing to say. We will wait for the motivation” said the lawyer Neri Pinucci, lawyer together with his colleague Bruna Scatigna of the family who has taken the civil action. Luca Dini doesn’t want to talk. «He’s disconcerted – explains the lawyer – why should a new trial be held, the third, only for the requantification of the sentence. But they are the rules of the game.”
