Children killed in explosion in Maccalube: all accused acquitted

The judges of the second criminal section of the Court of Appeal of Palermo, overturning the sentence of the Agrigento court, acquitted Domenico Fontana, former president of Legambiente and former environmental councilor of the Municipality of Agrigento, “for not having committed the crime”, and Daniele Gucciardo, operator in service at the Maccalube and current president of the Rabat club in Agrigento at the trial resulting from the death of his little brothers Laura and Carmelo Mulone, aged 7 and 9 who died in September 2014 following the explosion of the small volcanoes at the Maccalube in Aragon.

Five years ago the Court of Agrigento had ordered two convictions and one acquittal: 6 years of imprisonment for Domenico Fontana, former president of Legambiente and former environmental councilor of the municipality of Agrigento; 5 years and 3 months of imprisonment to Daniele Gucciardo, operator on duty in the Maccalube; acquittal (because the fact does not constitute a crime) for Francesco Gendusa, manager responsible for the protected areas.

Little Laura and Carmelo Mulone were accompanied by their carabiniere father Rosario to the Maccalube of Aragon to celebrate the boy’s birthday with an excursion. Shortly thereafter, tragedy struck: a tide of mud and earth, due to the explosion of a small volcano, overwhelmed and killed the two children.
