Demolition order for the Luchia in Cagliari

A managerial determination comes from the Municipality that has the effect of a torpedo on the Luchia, the very popular kiosk on viale Buoncammino in Cagliari: it must be dismantled, lThe concession was revoked forever.

The measure, with immediate effect, starts from the Municipality’s Heritage service: it doesn’t just talk about tables, chairs and planters placed without authorization or DJs who played music in violation of the acoustic piano. There is also the reference to unpaid fees and unpaid fines.

This year it turned out that, despite downward recalculations «the debt position had worsened further due to an outstanding amount resulting from a local police report dated October 20, 2023. The company was therefore owed a sum of 18,103.77 euros.” The forfeiture procedure was started when the local police ascertained that the same company “operating the kiosk bar business, installed and used, in the absence of a valid qualification, an electro-acoustic system for the amplification and sound diffusion of musical pieces managed by a DJ and occupied part of the public land adjacent to the kiosk for a total of 99 square metres”.

Through a professional firm, the company contested the quantification of the arrears. The Municipality rejected the reconstruction. No findings were made in the officers’ reports.

So here is the forfeiture of the concession. But also therenotice “to the company” for the “removal of the kiosks and accessory artefacts and the reclamation and restoration of the state of the places in the occupied area within 30 days from the notification of the provision”. If the owners don’t think about it, the Municipality’s bulldozer will arrive and the costs will be borne by them.

The effectiveness is immediate, unless an appeal is received.
