The former director general of Healthcare of Lombardy, Carlo Lucchinawas sentenced on appeal by the Court of Auditors to compensate 175 thousand euros to the Treasury to have prevented the interruption of the treatment that kept Eluana Englaro alive on the basis of a “personal and ethical conception of the right to health“. The accounting judges wrote this in the ruling reported by the Milanese edition of Corriere della Sera.

In 2009 Eluana’s father, Beppino Englaro, was forced to transfer his daughter to a health facility in Udine where the 39-year-old, in vegetative state for 17 years due to a serious car accident, he died on February 9 of that year. In 2008 it was in Beppino Englaro denied the possibility of stopping artificial feeding who kept the daughter of the former Lombard healthcare director alive with a circular in which he ordered the doctors who were treating her not to “fail to fulfill their professional obligations” despite the fact that a year earlier the Court of Cassation had established that every person can refuse care that it deems unsustainable and degrading.

The Court of Appeal of Milan had also authorized the interruption of life-sustaining treatment. The Lombardy Region was sentenced to pay approximately 175 thousand euros for the damages suffered by the Englaro family, public money for which the accounting proceedings then began. “It wasn’t aconscientious objectionbut the directives also received from the regional attorney’s office have been applied”, said the former general manager Lucchina, reports the Via Solferino newspaper, he will evaluate whether to appeal the ruling of the Court of Auditors of Appeal to the Supreme Court.
