The long dispute over sports facilities. Council of State, the Municipality wins

On the management of the municipal sports facilities of Anzola, the Council of State, with a ruling last Friday, has given the Municipality the right. It is the tug of war, between the Municipality of Anzola (when Giampiero Veronesi was mayor) and the Polisportiva Anzola that lasted several years. The Polisportiva Real Sala Bolognese – which had initially won the municipal contract, in the tender then challenged by the ‘rivals’ of the Polisportiva Anzola – has become in all respects the legitimate manager of the sports facilities. “I am satisfied – comments Veronesi – because I can say that we were right and that we fought a fair legal battle, which I claim”. “In the ruling – continues the former mayor – the Council of State reiterates twice, that the Anzola Sports Club had been invited in writing to participate in the tender that we had to do by law. And instead it never participated. The second point is that the Anzola Sports Club would have had all the time to immediately challenge the tender notice. And it didn’t do that either”.

In essence, the former mayor wants to highlight the fact that, if no one had participated in the tender, the Anzolese Sports Club could have obtained the best conditions from the Municipality precisely because no one had participated and there were no alternatives. This time, however, Real Sala Bolognese participated and was awarded the management of the municipal sports facilities. And the Anzolese sports club has excluded itself. “The fact remains – adds Veronesi – that the very important sums spent in legal terms could have been eliminated, if only the Polisportiva Anzolese had used common sense. In doing so, however, the Municipality had to spend taxpayers’ money as the Polisportiva spent and, consequently, its members”.

“Other administrations in the metropolitan area of Bologna – replies Ivano Parisini, president of the Polisportiva Anzolese – faced with cases similar to ours, and with the TAR ruling which annulled the new tender, maintaining the old manager, we in the case of Anzola, have decided not to squander further community funds to appeal to the Council of State. The transformation we are undergoing, especially in the last 12 months, has led to an increase in the costs of the facilities (over 40%) borne by the sports clubs present in our area. territory. Increases which have largely eroded the economic power of our Anzolese sporting families, without, on the other hand, having any compensation in terms of maintenance and investments”.
