The judge for preliminary investigations of Court of Trani, Marina Chiddorejected the request to dismiss the Public Prosecutor’s Office of Trani on the case of Claudia De Chirico, the 24 year old found lifeless in Terlizzi. The investigations into her ex-boyfriend have therefore been reopened, Davide Falcettanow under investigation for mistreatment.

There Power of attorneyfor its part, had formulated the fourth request for dismissal for the crime of incitement to suicide, now rejected, believing that no responsibility emerged against the young woman’s then boyfriend, originally from Molfetta and defended by the lawyer Francesco Montingelliwho had always reiterated that the couple had a stormy relationship due to her jealousy, stating that the girl had expressed her intentions to end it. 8 years later, the turning point.

For the judge, in fact, the legal qualification is different from that initially proposed – no longer incitement to suicide, but mistreatment in the family, for which the man could risk a sentence of up to 24 years of imprisonment – motivated in 62 device pages in which «the profile of a violent man (Falcetta), easy to anger – it is written in the document -, towards whom De Chirico was in a state of profound psychological awe and emotional dependence».

According to judge Chiddo «from the reading of the documents, De Chirico’s fragility and the state of solitude of the girl clearly emerge, who had left her family for love of Davide, a love which however made her suffer not only physically, but which he provoked them alienations and frustrations». For this reason, he believes the 24-year-old’s extreme gesture is a consequence «of the progressive condition of nullification of her person, due to the violent and threatening conduct».

The judge also spoke of Falcetta’s attitude «originating from jealousy, which induced the man to preclude her from social relationships, to check her telephone to check if she was having relationships with men, as well as addressing her with derisive words, so much so as to induce her a state of anxiety that makes her think of suicide».
