In Campania the summer sales for the 2024 season will begin from 6 July. The decision, shared with the trade associations, is contained in the Regional Council Resolution no. 279 of 06/06/2024.
The sales will last for 60 days, so as usual, they will start on the first Saturday in July and end in late September.
The Campania Region, with Regional Law n. 7 of 21 April 2020, “Consolidated law on trade pursuant to article 3, paragraph 1, of the regional law of 14 October 2015, n. 11”, (published in BURC no. 91 of 27.4.2020), article 43 established that:
“1- End-of-season sales concern seasonal or fashionable products, which are susceptible to significant depreciation if they are not sold within a certain period of time.
2- The end-of-season sales activity must be made known to customers through the appropriate means of information and without the need for any communication to the municipality where the business is located.
3- The start dates of the winter and summer end-of-season sales and their duration up to a maximum of sixty days are defined by decree of the manager of the competent administrative structure in compliance with the unitary guidelines adopted at the Conference of Regions and Autonomous Provinces”.
We also highlight that the same Regional Law, to the art. 44, paragraph 1, provided that promotional sales of all products that will be put on sale during the “sales” period cannot be carried out in the 30 days preceding said end-of-season sales; therefore promotional sales are prohibited from 6 June.
Given the above, we also believe it is appropriate to underline the main general requirements for carrying out these extraordinary sales, also in light of Legislative Decree no. 26 of 7 March 23 which establishes precise duties to avoid misleading consumers:
- during end-of-season sales, goods must be displayed to the public with the indication of the price charged 30 days before the extraordinary sale, as well as the percentage of the discount applied;
- such sales must be made known to the public by means of signs showing the exact wording and methods;
- during the “sales” can be put in sale only of the goods present in the sales room and any storage, with an express prohibition on further supply of goods purchased for this purpose.
