PIEDMONT – The Regional Administrative Court suspended the order to kill two wild boars, accepting the appeal presented by the Miletta Refuge, which is based in the Novara area.

History

The Agrate Conturbia refuge, near Novara, had presented an appeal to the Regional Administrative Court of Genoa to save the lives of two wild boars which, after being included by the Genoese ASL in the list of animals to be killed to prevent the spread of diseases such as the Plague pig, were welcomed by a private citizen (named Giordana) in Bargagli, Liguria. The managers of the Sanctuary had immediately taken the cause to heart and had appealed to the Court, maintaining that the two wild boars were healthy.

For this reason, the lawyer Angelita Caruocciolo was hired, who in recent days obtained from the judge a “urgent monocratic decree“. This is a provision that is taken by the judge alone, that is, without consulting the college as the procedure would require, and has immediate effect; this procedure is implemented “in cases of extreme gravity and urgency, such as not even allowing an extension until the date of the council chamber”. In this case the urgency was the life or death of the wild boars.

The choice of the TAR

The judge’s decision, explains the lawyer Angelita Caruocciolo, “takes particular account of the good health of wild boars, a condition ignored by the ASL, and therefore considered it there is no danger to the community given the irreparable damage to the animals.”

The culling measure has only been suspended, in the coming weeks the actual cross-examination will be discussed which could cancel what the Refuge and Caruocciolo define as “execution of the capital sanction”.

We will therefore await the confirmation of the decree in chambers by a panel of judges gathered around end of June.
