Terni – (sil.co.) – Maxifraud with false VAT credits, there is also an entrepreneur from Viterbo in the meat sector among the 42 natural persons and 39 legal persons, against whom preventive seizures were started last May 23rd for equivalent for over 12 and a half million euros as part of the Lybra operation of the financial police coordinated by the Terni prosecutor’s office. In particular, a precautionary measure worth over 150 thousand euros has been ordered against the man from Viterbo.
During the operation which arose from a criminal system that allegedly helped companies to evade taxes, jewellery, watches and various luxury accessories, bank securities and cash in euro and foreign currencies were seized.
The Viterbo native is a 69-year-old defended by the lawyer Alessandro Bacchi of the Perugia Bar. The name of his company appears to have emerged from the five takeover contracts found during the first inspection at the headquarters of the tax and fiscal consultancy firm at the center of the investigations.
The examination of the payments of debit taxes (Treasury, INPS, Inail, Regions) made by the company using F24 forms, present in the database of the tax registry – collections sector in use by the body made it possible to detect those made using in compensation the non-existent credit of the “borrowing” companies, with the indication of “subject other than the beneficiary of the credit”.

Seven people are under investigation in the Umbrian capital, six of whom have no criminal record, defended by the lawyer Samuele De Santis of the Viterbo Bar, some of whom are accused of criminal association.
The investigation was born in 2019 following a tax audit carried out on a tax and fiscal consultancy company, formally resident in Rome but actually operating in the Ternano area, which carried out the function of “guarantor” in the institution of tax collection with the role of intermediary between the paying party and the paid party.
The sole director is a 68 year old defended by De Santis. The lawyer also assists the legal representative of the fuel depot seized by the finance company in the industrial area of Terni, whose sale, five years ago, triggered the investigations.
A series of inconsistencies immediately emerged which placed Terni at the center of the huge fraud, because the tax consultancy firm was active here and created false VAT credits and then resold them to third-party companies. The latter would have used them to reduce their debt to the treasury through fictitious companies opened by frontmen, all doing nothing, who generated false invoices and therefore false credits, then sold at a premium.
The provision was issued by the investigating judge of the Terni court for the crimes of criminal association aimed at tax fraud, undue compensation, issuing invoices for non-existent transactions, money laundering and self-laundering.
The ablative measure affected the corporate complexes, assets and financial resources of the suspects in the territory of Terni and 14 other provinces (Viterbo, Milan, Turin, Novara, Verona, Lucca, L’Aquila, Teramo, Rome, Naples, Potenza, Catania , Sassari and Nuoro), as well as in Romania, thanks to the collaboration of the judicial authorities through Eurojust.

Presumption of innocence
In the Italian criminal system the presumption of innocence applies until the final sentence. Presumption of innocence which is based on article 27 of the Italian constitution according to which a person “is not considered guilty until finally convicted”.
