The Flaica Cub of Benevento opened on 05.31.2024 the state of agitation – 1 phase – of the contracted staff who take care of the canteen service at the Benevento PO, also inviting the Health Directorate itself to verify the correct management of the service by of the contracting company: Dussman Service Srl
Below are the reasons that pushed Flaica to intervene in defense of workers:
The undersigned OS is hereby forced to report the following to the San Pio Hospital in Benevento:
A)- with the attached notes dated 04/29/24 and 05/08/24 this OS, the most representative union at the Production Unit coinciding with the Hospital Canteen, expressed its dismay to Dussmann Service srl for the umpteenth time For:
a)- retaliatory and revengeful behavior carried out by the Company towards the 3 workers to whom, after years of litigation, Dussmann had been forced to recognize the right to work full-time hours, only for this reason they were forced to work split shifts in such a way to spend the entire day, including long breaks between one semi-shift and another, also taking away their free hours from family commitments, this WITHOUT ANY ACTUAL ORGANIZATIONAL REASON;
b)- consequent UNFAIR DISCRIMINATION FOR FEMALE STAFF affected by the retaliatory measure;
c)- further damage caused to the RSA of the Union which was effectively prevented on some days from using the canteen, even if it was paid for;
d)- systematic additional time commanded to the other employees IN CONTINUITY with their ordinary shift or TO REPLACE the 3 employees upon their forced removal at the end of each daily semi-shift, in clear contradiction with the logic of the commanded split-time shift to the 3 registered workers (if continuity of the shift is needed, why not order it to the 3 workers without ordering it to others, even overtime?);
e)- failure to convene the Trade Union Organisation, despite an express and repeated request, despite the fact that the CCNL applied provides that the determination and duration of fractions of time in split shifts must be the subject of supplementary bargaining at a territorial level;
f)- unilateral removal of ROL PERMITS from staff WITHOUT ANY REASON and WITHOUT THE STAFF USING THEM;
g)- dramatic shortage of staff following the retirements that occurred since DUSSMANN took over the service;
B)- the San Pio Hospital MUST verify compliance by the contracting companies with the most basic obligations, which are clearly violated here, in particular that of compliance with the contractual conditions which, following the award, the company agreed to committed not to infringe;
C)- the Hospital MUST verify that the service is carried out with QUALITY and EFFICIENCY. The Labor Inspectorate responsible for the area has already issued numerous sanctions against the previously contracting company for excessive use of additional work. We hereby point out blatantly DISCRIMINATORY behaviour, which also causes damage to the person, for which the contracting authority could also be called to respond for culpa in vigilando;
– having said this, the undersigned Trade Union Organization
1)- reports the seriously anti-union behavior which is at the same time detrimental to the rights of the individual workers concerned by DUSSMANN Service srl at the Production Unit of the canteen of the San Pio Hospital;
2)- requests the immediate intervention of the San Pio Hospital so that
— verify the effectiveness of what is contested;
— obliges the Company to respect trade union prerogatives and to convene the undersigned Trade Union Organization as required in the previous warnings.
Until then the undersigned trade union organization pursuant to art. 2 paragraph 2 of Law 146/90 and subsequent amendments proclaims the state of agitation – 1st phase – of the canteen staff of the San Pio hospital in Benevento.
