“A month before the work was called off, we took legal action filed at the court of Ancona, against the Region, given its obstinacy in not wanting to take any corrective action to tender-based project which has significant gaps in terms of worker safetyas well as for the lack of works to be designed from scratch and necessary for the realization of the works, so much so that in its current state the work would be untestable and unusable due to objective shortcomings”. This was declared in a note by is the Cagnini Costruzioni company in relation to revocation of the contract for the construction of the cycle-pedestrian bridge over the Chienti river announced by the regional councilor Francesco Baldelli.

The problems raised, according to the construction company’s version, “do not adhere to detailed aspects such as to be deferred to the organizational capabilities of the same, but involve real design choicessuch as hydraulic works, foundations in the bed of 20 meter high metal towers, and such as those attributable to ‘vibrations of metal structures’ such as to prevent pedestrians from crossing the bridge safely once the work is completed.”

This aspect can be remedied, according to the team of expert consultants called upon by Cagnini Costruzioni for technical assistance in the construction of the metal deck, only with the inclusion of damping systemsnot currently foreseen in the tender-based project, and of significant cost, capable of guaranteeing, where possible, the comfort requirements for vibrations induced by pedestrians and the dynamic effects of the wind that current regulations require”, specifies the company.

“Not to mention the gaps in terms of worker safety – continues the note -, as not even the most basic measures for the protection of workers commensurate with the various implementation phases have been envisaged, in a complex environmental context with specific risks connected to work in the riverbed, and in a polluted and contaminated site, this last aspect aggravated in light of theJune ordinance of the mayor of Civitanova“.

Precisely following the provision signed by Fabrizio Ciaracapica, Cagnini Costruzioni announced that it wanted to begin “first the works on the Sant’Elpidio side and wait for the Civitanova Marche side, for all due protection for the health and safety of the workers, the necessary investigations in thanks to the risk analysis, commensurate not only with occasional users of the cycle path, but also with workers exposed to continuous risk”.

“However, the solution was rejected by the contracting authority”, explains Cagnini Costruzioni. The same one that revoked the contract for “alleged breach of contract by the company”.

“Nothing should surprise us if we note that the final project was approved on November 23, 2022, validated three days later, and that the executive project was drawn up and approved in less than a week on December 6, 2022, truly in record time”, highlights the company.

The legal action that Cagnini Costruzioni has undertaken to protect itself, “for the first time after 30 years of activity” state the company’s management, followed months of discussions, meetings and correspondence, during which ” we have constantly sought – they continue – every form of collaboration with the Contracting Authority to allow the construction of the work safely, but finding an adamant position of closure on the part of the Institution and the total unavailability to remedy the serious shortcomings of the project both on a technical and economic level”.

“Furthermore, to provide those who attended the inspection on 21 March 2023 with ample reassurance on the capabilities of the Cagnini Costruzioni company in completing and carrying out the works, it is worth mentioning similar works carried out by the same company in the last period”.

“The bridge over the Apone river with a span of 460 m and related ramp, for the Iricav Due Consortium – Verona-Padua High Speed/High Speed ​​Line, twelve piers and four abutments completed in less than seven months. All works in progress – concludes the note – such as bridges, overpasses and artificial tunnels just built as part of the Maxilotto 2 works – Quadrilatero Marche-Umbria, for the 2nd section of the Pedemontana delle Marche between the Matelica Ovest junction and the Castelraimondo Nord junction”.
