Death in the ward of an elderly woman from Fontana Liri: the family members’ opposition to the request for dismissal made by the public prosecutor was accepted. Now the judge orders new investigations. There is a twist in the case of the woman who died at the Spaziani hospital in Frosinone after a previous hospitalization at the Ini Città Bianca facility in Veroli. The 77-year-old woman, who was in good health, had been hospitalized to receive rehabilitation assistance following a hip fracture that had already been treated surgically.

She arrived at Spaziani on 12 February after spending nine days in the Veroli nursing home for rehabilitation after the operation in Alatri. The son – before his death – was made to understand that his mother’s clinical collapse was linked to the administration of a medicine during hospitalization at the White City, the so-called metmorphine, which had caused a metabolic acidosis. An alleged medication error which pushed the man to report the case to the Frosinone public prosecutor’s office as early as 13 February. In the meantime, while her mother was in the hospital in the capital, she had atrial fibrillations, but it seems that the immediate diagnosis and therefore the treatment were omitted. Ten days later – February 23 – the pensioner’s death. The consultations immediately highlighted “improper and negligent conduct of the healthcare personnel”, we read in the papers. The prosecutor had, however, requested the dismissal of the proceedings as it was impossible to “identify the healthcare workers to whom the omissions were attributed” nor “to fully ascertain the causal link between the individual negligent behaviors attributed to the healthcare personnel”. In essence, the individual alleged acts of imprudence and negligence found by the technical consultancy and traceable to the conduct of the doctors of the two healthcare facilities would not have allowed the individual responsible parties to be identified. But his loved ones continued to seek clarity from him, his children continued their battle by challenging the request for dismissal formulated by the Public Prosecutor and the investigating judge accepted the opposition of the family members by ordering new investigations. The Judge for the Preliminary Investigations agreed overall with the requests formulated by the opponents through the lawyer Antonio Carugno. “I welcomed with great gratification the reopening of the investigations aimed at identifying the responsibilities of this death, and not only for my professional work but above all for the lady’s family who need to know and pay homage to the memory of their mother”, he said. said the lawyer. Well, the investigating judge ordered the reopening of the investigations requested by the opponents and then making any necessary entries in the register of suspects. For lawyer Carugno, excluding “the criminal liability of healthcare personnel could create a dangerous precedent that would legitimize negligent conduct without any consequences”.
