The governor’s lawyer: “With the elections one of the reasons for the measure falls”

“This morning I presented to the investigating judge’s offices at the Court of Genoa a request for the revocation of the house arrest of the President of the Regional Council Giovanni Toti. The request was signed not only by the undersigned, but also by Toti himself, who makes all its contents his own.” This was stated in a note by the lawyer Stefano Savi, lawyer of the suspended Ligurian governor Giovanni Toti.
“Without going into the merits of the matter and the reasons for the precautionary measure – he underlines – we believe that, in any case, today there are the conditions for the revocation of the measure, or, alternatively, for its attenuation”. “As for the risk of repetition of the crime, the celebration of the electoral round – concludes Savi – overcomes one of the reasons given for the precautionary measure. Furthermore, the Toti list did not participate in either the European elections or the concurrent administrative elections”.
Legal Toti: “Forfeiture not foreseen by law”
“The next electoral consultations in Liguria will be held in about a year and a half and will concern the renewal of the Regional Council. If this future political commitment is taken as a reference, it seems clear that the suspension from the function of President linked to the precautionary measure would be characterized as a real forfeiturenot provided for by law precisely to protect the popular will expressed through free elections” continues the note.
“With regards to the risk of repetition of the crime – specifies the lawyer – taking into account the very long period of the investigations, four years, the disputed facts could only be episodic compared to the number of electoral campaigns undertaken and the fundraising activity for political purposes. This alone demonstrates the non-existence of the alleged “system”.
