He survives a collision with a tram but he dies after a month in mysterious and particular circumstances reconstructed in the damage compensation process initiated by the heirs.

In October 2010 the woman was hit by the tram in Florence and survived the impact, and after immediate hospitalization due to the serious traumas she had suffered, she had been transferred to a specialist center for serious brain injuries in the province of Pisa but a month later she was found dead, near the facility, due to cardiac arrest due to hypothermia.

For the Court of Pisa there are no doubts about the woman’s responsibility for the event “It had to be looked at closely”and condemned the facility to compensate the two children with 630 thousand euros plus 17 thousand euros in legal costs, for failure to supervise the patient.

The woman, of Ukrainian origins, was 56 years old at the time managed to get away from the center where she was hospitalized and found dead the next day by the police who had started investigations after the center reported the patient’s disappearance.

In fact, according to the sentence signed by Judge Alessandra Migliorino of the Court of Pisa, the woman did not receive adequate supervision and security measures from the structure.

During the trial it emerged that the woman had arrived at the specialized center for the hospitalization of patients requiring long intensive care, with multiple traumas and was confused and in pain and also very agitated. Furthermore, she was not self-sufficient.

The patient’s state of confusion and agitation was known to the facility’s health workers and the woman was basically bedridden and was moved around the center in a wheelchair only for special needs. Finally, according to the trial report, the doctors and health workers should have arranged for every measure of custody and protection of a patient with reduced self-defense, unable to independently satisfy basic physiological needs (eating, drinking, sleeping, going to the bathroom) or to effectively communicate her needs, taking into account, moreover, the will, expressed several times, to leave the facility when she was most agitated.

But that day, November 21, 2010, the woman she is inexplicably left alonesitting on the wheelchair in a room of the facility so much so that, again according to the sentence, the woman manages to leave the center without problems, probably between 2pm and 4pm, i.e. between the time she was last seen and the time in which the structure notices his absence.

A period of time judged too long by the Pisan Court which therefore condemned the center to compensate the heirs, the son and daughter of the woman who was later found dead near the facility approximately 24 hours after her escape from the center which should not have happened if the control and surveillance mechanisms of the rehabilitation center had worked. These are the decisions of the first level of judgement.
