OBJECT: Salerno Highway Patrol Section, Impunity for those who make mistakes and random rules against Policemen. Request for very urgent intervention

Dear Mr. Director,
last 11 December 2023 and then subsequently on 10 May 2024, this Secretariat concerned your Office (the second letter was addressed to your direct attention) regarding a series of violations of the rules established by the current ANQ which were carried out at the Traffic Police of the province of Salerno.

The requested urgent intervention aimed at putting an end to the singular interpretation of the rules on shift changes, regarding respect for time structures, decentralized agreements, etc., found the usual interest on the part of your Office but unfortunately not the solution to the highlighted problems… and now the situation is evolving dangerously and which, in the absence of your immediate intervention, could force both some colleagues and this OS itself to bring the issue to other institutional settings, without failing to inform public opinion.

In fact, it seems that they want to blame the staff for the many errors committed by the manager of the Section and by the commander of a dependent department… and this claim is truly unacceptable.

In particular, following the failure to indicate in the daily service orders the 13 minutes added (5 before and 8 after) in the shifts relating to continuous services, rather than attributing responsibility to those who signed those service orders, it was decided to count all those 13 minutes, without even checking whether the staff had actually completed them (as they probably had done, waiting for the necessary activities at the beginning and end of a duty shift), and the “failure to complete the weekly time” and the recovery of thousands of minutes which in some cases correspond to 10 or more working days.

The premise of the letters signed by the Director of the Polstrada Section of Salerno, recently notified to colleagues, is that “there is no element of fault attributable to SV” and that “this Office is oriented towards applying the provisions of the art. 3, co 15-ter of the Legislative Decree. 95/2017”, which establishes that:

The days of absence from service unduly used by the employee who does not intend or is unable, within the deadline indicated by the Administration, to request that they be attributed to a corresponding period of ordinary leave are commuted to leave without allowances not useful for any other purpose.
Unpaid leave is useful for all other purposes in the absence of fault on the part of the employee.

Now, although anyone, even just doing a literal analysis of the law, would have understood that the aforementioned art. 3, co. 15-ter, is not applicable to the disputed situation (without fault), this claim once again demonstrates the incomprehensible and unacceptable claim of the Salerno Polstrada Section to waste the rules and/or their correct implementation. First, and still now, with the ANQ regulations and now with this introduced by the aforementioned Legislative Decree. 95/2017.

Furthermore, the aforementioned claim testifies to a desire not to blame the errors made on those truly responsible!
I therefore invite you, Dear Director, to intervene immediately, blocking the absurd and illegitimate claim of the manager of the Salerno Traffic Police Section to reduce days of ordinary leave, or to place staff on leave without pay, by applying a rule which has no relevance to the case in question, and also wants to impose the counting and payment of all shift changes arranged over the years without due remuneration, as well as compliance with all the rules that regulate the employment relationship of policemen.
