The Public Prosecutor’s Office of North Naples has executed a preventative seizure decree, issued by the investigating judge at the Court, against 800 companies, for credits connected to incentives relating to aid for economic growth, for a total value of over 117 million euros. The measure was introduced in 2011 to encourage the capitalization process of Italian companies characterized by poor economic consistency and was then revised with the «Sostegni bis» Decree, which strengthened its effects.

The cross-referencing of the data collected on the forms used by the beneficiaries to request the credit with the values ​​reported in the relevant financial statements and in the declaration tables, when present, revealed how numerous companies had sent false declarations to the Revenue Agency, indicating that having achieved capital increases, which in reality were never realised. Furthermore, the in-depth analysis of the position of some natural persons, often recurring in their capacity as signatories of the forms, as well as of the temporal data reported therein, sometimes prior to the date of the start of the company’s activity, confirmed the feared illicit conduct , highlighting a high waste of public resources that must be curbed promptly.

At the end of the investigations, 800 irregular positions relating to as many companies and business activities were reconstructed, attributable to 594 natural persons, over half of whom reside in Campania, held responsible for the crime of aggravated fraud against the State for having transmitted forms with fictitious data to the Revenue Agency, to obtain a credit which is then transferred to third parties, thus fueling the “black market” of tax credits to be transferred to the companies most exposed to taxation.
