Rimini, the “Birrodromo” makes too much noise, the judge intervenes

With a sentence issued on April 16th, the civil judge, Dr Maria Saieva, accepted the appeal of some citizens residing near the Birrodromo in the former Padane area of Rimini, to obtain pursuant to art. 700 cpc “the cessation of noisy emissions emanating in the evening and night hours from the restaurant-pub activity in the relevant external area”

The Judge addressed all the administrative and technical aspects of the problem, also appointing a CTU (Office Technical Consultant) to measure the noise emissions directly in the homes of the residents who made the appeal.

The result was exceeding the decibel limit set by current laws. There is talk of exceeding the decibels in the summer period with the windows open.

For these reasons the judge ordered the following solutions:

  • Moving the customer entrance from the current location to the side entrance
  • The observance of a maximum limit of 60 people overall present in the two external equipped areas. Currently there is the possibility of hosting 210 users – of which 140 in the area adjacent to the entrance and 70 in the courtyard behind
  • The period of these limitations goes from 15 June to 15 September and in the time slot from 10pm until the restaurant closes

As an alternative to these restrictions, the “Birrodromo” should install external dehors or a noise barrier.

The residents who appealed were represented and defended by the lawyer. Alessandra Giorgia Vittadini
