The comment of the lawyer Andrea Maestri after the decision of the Ravenna court for the events that occurred at the cemetery in 2020

The Ravenna court in a pre-trial hearing acquitted two men of the accusation of having violated the Mancino law on the occasion of the commemoration of the fascist hierarch Ettore Muti at the Ravenna cemetery on 23 August 2020. Andrea Maestri, lawyer of the provincial anti-fascist council, comments as follows: «I observe, as a citizen and as a jurist, that I would not like to raise my children in a country where one can freely and with impunity glorify a fascist squad member like Ettore Muti, make the call of the present and the Roman salute. A country in which two current laws, the Scelba law and the Mancino law, legal barriers erected in defense of democratic and constitutional values, are in fact disregarded.”

That of Ravenna is one of the first rulings following the well-known ruling of the United Criminal Sections of the Supreme Court, filed on 17 April. «The crime contested by the Ravenna prosecutor’s office is article 2 of the Mancino law, a crime of presumed danger which is also carried out with the Roman salute and the call of the present, which for the Court of Cassation are objectively attributable to the fascist ritual (articles 3 and 9 regulation of the Pnf) and were implemented in a “significant overall factual context” that is, during the public, reiterated, ostentatious exaltation not of just any figure but of Ettore Muti, squad member and secretary of the Pnf. The aims of ideological exaltation and proselytism are clear. We expect, within 90 days, to read the reasons for a ruling that leaves us dumbfounded and saddened.”
