Bologna, 12 June 2024 – Giampaolo Amato remains in prison because “the precautionary needs are based on multiple elements, including the economic motive, the seriousness of the facts, the repetition of the crimes and the personality of the perpetrator».

So the Court of Cassationwho in recent days filed the reasons for the sentence with which he rejected the appeal of the defenders of Amato, 64 years old, ophthalmologist and former Virtus doctor, in prison since 24 April 2023 for the murder of his wife Isabella Lsala and his mother-in-law Giulia Tateo and currently accused before the Court of Assizes for both crimes.

The lawyers Gianluigi Lebro and Cesarina MitaritonnaAmato’s lawyers, had appealed against the prison custody order issued on 28 October by the investigating judge also for the murder of his mother-in-law, arguing that there was an absence of motivation on the part of the judge regarding the existence of precautionary needs and underlining how they were elements of the investigation from which the absence of psychological or physical violence by Amato towards his ex-lover emerged and therefore there would not have been a risk of recurrence were overlooked.

But the Supreme Court rejected this thesis and deemed the precautionary needs to exist because, “regardless of the sentimental motive, on multiple elements, including the economic motive, the gravity of the facts, the reiteration of the crimes, the personality of the perpetrator of the same in light of the extreme and lucid organizational capacity for heinous crimes and its cynical and unscrupulous criminal capacity, which cannot otherwise be contained except with the maximum precautionary measure, as explicitly highlighted by the contested provision”.

Therefore Amato remains in prison. According to the Prosecutor’s Office, Amato killed his wife and mother-in-law, poisoning them with a mix of drugs, to collect the inheritance and to be able to freely live the extramarital affair he had been carrying on for some time. The accused is scheduled to be examined at the next trial hearing, on June 18th.
