In January the suspect had appealed to the civil court of Modena for separation with charges against the woman, contesting the Austrian jurisdiction.

He didn’t want to give up

Despite the appeal of her husband (computer engineer and pentathlon enthusiast), the Modena court had confirmed the provisions of Innsbruck. The judges inform the prosecutor’s office, without taking urgent temporary measures, as there is already a decision from a foreign EU judge, recognizable in Italy. In May there was the preliminary question of jurisdiction (i.e. territorial jurisdiction). In February the victim had presented another request to the Innsbruck court, to obtain theexclusive custody of the two children.
