FRANCAVILLA. The urban planning agreement stipulated by the Municipality in 2021 risks ending up in the Prosecutor’s Office (council Luciani) with the company Maestrale srl «regarding the buildings under construction on the Asterope roundabout». The case was triggered by the Fratelli d’Italia city club, which requested the intervention of the Prosecutor’s Office after the opinion of the lawyer Ciaglia of Rome, appointed by the municipal administration, “following the formal interpellations of the opposition city councilors”, as the city club of Fratelli d’Italia writes in a note. «From the conclusions resigned by the lawyer», we read in the note, «it emerged that the private individual sold to the body land already acquired by the same in 1969 with a previous agreement; other lands had already been de facto acquired by the entity and used for roads since time immemorial, as well as being acquireable through adverse possession; in any case, the ceded areas would never have been able to develop volume because they were already intended for roads; the compensatory transfer mechanism, i.e. transfers of land in exchange for volume, was not applicable; and the volume transferred by the entity is not only illegitimate but also excessive”. Hence the councilors’ attack Rocco Cappelletti (FdI) e Giovanni Angelucci (Lega): «The political responsibility of the old administration is in not having involved the city council in the agreement, the responsibility of the current administration is in having remained silent for 18 months on the questions of the opposition. Only thanks to the diligent work of the secretary general was some answer possible.” From here Fratelli d’Italia makes it known, «through the city secretary Daniele Cozzathat «FdI announces battle on any amnesty and asks that the administration protect the territory with concrete actions, hoping to find the Democratic Party at its side».
The mayor explains Luisa Russo: «The Maestrale agreement was stipulated in 2021 by the last administration with an act by the manager that did not pass through politics. The mayor’s task cannot be to control the legitimacy of administrative acts undertaken by managers and offices. On the matter, at the request of the mayor, the manager has always confirmed the correctness of his actions. This council then, following a note from the general secretary, immediately requested to obtain a legal opinion to understand the issues raised. Following the acquisition, a few days ago, a serious study is needed to identify the initiatives to be undertaken.” And he adds: «Alongside this problem, linked to a building practice managed and processed by the offices without formal involvement of the political party, this administration immediately started a process to stop the volumetric increases on our coast: we are working on the variation to the master plan , after over 30 years, a few days ago we approved the building regulations, we are working on modifying the technical implementation standards, and months ago a resolution was approved which contains the volumes in the areas between the sea and the railway. The truth is that when this administration proposes and adopts important measures to reduce volumes and to govern the territory in an eco-sustainable way, the opposition votes against”.
