The confiscation of over 14 million euros from a multiple criminal offender has been confirmed by the Court of Appeal of Bologna. Among these also one million and 800 thousand euros in credits for the 110% bonus and facade bonus. The confiscated companies operated in the construction of residential and non-residential buildings, retail trade of building materials, and manufacturing of computers and peripherals. The maxi seizure also included 9 buildings and 44 lands in the provinces of Rimini and Pesaro and Urbino.

The provision

The Financiers of the Provincial Command have implemented a provision of the 1st Section of the Court of Appeal of Bologna, which confirmed the Decree issued by the Court of Bologna on 12 December 2022, with which it had been applied to a criminal permanently residing in several years in the province of Rimini, the prevention measure of special public security surveillance with the obligation to stay in the municipality of residence. Also confiscated were 6 companies with registered office in Rimini and its province plus financial resources for 210 thousand euros and credits for over one million and 800 thousand euros deriving from works carried out taking advantage of the 110% bonus and facades.

The confiscation

The confiscated companies operated in the construction of residential and non-residential buildings, retail trade of building materials, and manufacturing of computers and peripherals. Criminal proceedings are also pending against the convicted criminal at the local Public Prosecutor’s Office for the provisional hypotheses of the crime of fraudulent transfer of values ​​and fraudulent subtraction of the payment of taxes, in the context of which last week a provision was carried out with the which – at present and without prejudice to any subsequent assessment on the merits – the application of house arrest was ordered, a provision which became irrevocable following the ruling of the Supreme Court of Cassation of 10 April 2024.

The precautionary measure

The personal precautionary measure was issued as part of the preliminary investigation phase, on the basis of the current evidentiary acquisitions. The confiscated assets are currently managed by a Judicial Administrator appointed by the Bologna Court. The service activity in review once again demonstrates the high attention of the Financial Police and the Public Prosecutor’s Office which continues to be directed towards the identification and consequent attack of illicitly accumulated assets and financial resources, with the aim of stemming the pollution of the market and of healthy entrepreneurship, with the aim of restoring adequate levels of legality, transparency and public safety.
