PERUGIA – She takes care of an abandoned dog who has chosen her home as a retreat, the local health authority fines her because she did not register the new member of the family, but a judge overturns the result and in the end forces the health company to pay.
Thus ended, before the Justice of the Peace Carlo Gambucci, the battle of a 55-year-old from Perugia who in 2019 was sanctioned by the Department of Prevention – Veterinary Service of Perugia for having been found at home with a very sweet white and brown boxer, but not registered in the canine registry. Dog which, according to the appeal presented by the woman against the fine, «had been wandering around the lady’s property for some time – reconstructs the judge – and that she, moved by compassionate love towards animals, had taken him into custody six days before the intervention by the ASL”. The 55-year-old, assisted by the lawyer Giuseppe De Lio, also brought her husband before the judge, who confirmed her facts exactly during the hearing. With Gambucci recalling that “the burden of proving the basis of the sanction claim” lies with the ASL itself, which in reality did not even appear in court. And therefore, after the perhaps too hasty fine, you lose the money from the canceled injunction and now you also have to pay 350 euros in costs to the woman who loves animals.
