The emergency of the broken roads in the PISTICCI area has taken on the characteristics of a real emergency. Despite repeated requests and questions also in the City Council (see, video stenotypes), the problem has not yet been resolved, it exists and is increasingly becoming a real emergency. Pisticci lacks a regular operational road maintenance activity and that bad management also exposes the Municipality to legal proceedings linked to the increase in accidents, causing inconvenience to citizens but also damage to the image and municipal coffers. Today, those who travel by car risk serious mechanical damage, in the best of cases, while those who use motorbikes or on foot can even fall disastrously.
Despite the many reports from many citizens via social media, no corrective measures or measures to restore the road surface have been observed. It is hardly necessary to remember that it is the body that owns or manages the road that has to monitor the state of the road surface in order to prevent and reduce any damage to property and people. In fact, law no. 241/1990, also known as “transparency law”, establishes the right of every citizen to report an anomaly or disservice directly to the managing body which also provides for the opening of an administrative procedure of the outcome of which the citizen must be expressly informed.
It should be noted that there is a real one road hazardtherefore, those must be understood dangers hidden on the ground that road users can stumble upon. Therefore, one rough road can represent a pitfall. The matter of road hazards is regulated by specific rules. Based on article 2043 of the Civil Code the body that owns or manages the road – for example the Municipality, etc. must provide for the maintenance of the road surface as quickly as possible.
The owner (or manager) of the road is presumed responsible, also pursuant to art. 2051 of the civil code, for accidents attributable to dangerous situations connected to the structure or appurtenances of the road itself, regardless of its extension, unless it gives the proof that the harmful event was unpredictable and not promptly avoidable or reportable (C. Cass., Section III, 12/4/2013, n.8935; see then Cass. 18753/2017; Cass. 11526/2017; Cass. 7805/2017; Cass. 1677/2016; Cass. 9547/2015; Cass. 1896/2015).
In our opinion, it is essential that in order to deal with the serious situation that has arisen, a real special program for the restoration of the roads in the Pisticci area with one task force that provides with URGENCY to identify, geo-reference, map and restore the many critical issues, in the shortest possible time, also following up on old projects already entrusted as far back as October 2023.
