After being included in the ranking, he was called to undergo the tests required for operational efficiency.
During the fourth test, the pull-ups, he lost his grip due to the wet grip of the exercise equipment, suffering a shoulder injury that prevented him from completing the test.
Hospitalized for checks, the commission nevertheless decided to exclude him from the procedure.
Not agreeing with the decision, GG appealed to the TAR of Lazio through the lawyers Girolamo Rubino and Giovanni Bellia. They claimed that the injury was due to the condition of the apparatus and asked for the test to be repeated.
With an order dated 24 January 2024, the TAR found that the documentation produced confirmed the causal link between the injury and the pathology found, ordering the repetition of the test and possible participation in the subsequent phases.
After repeating the assessment with positive results, Mr. GG was admitted to the final stages of the insolvency proceedings with the order of 24 April 2024.
