However, the fact of having entered it from the beginning in form 45 reasonably suggests that no further investigation will be carried out (unless particular events, such as for example a hypothetical bankruptcy of the Nerazzurri club, which in this case would provide the input for a verification of bankruptcy crimes). It is more than probable, therefore, that the Public Prosecutor will archive this complaint in a short time, given that, moreover, there is no current insolvency of the Nerazzurri club with respect to the economic and financial commitments undertaken by it. In this regard it should be noted that the archiving it will not pass through the Judge for Preliminary Investigations, as in this case the Public Prosecutor has an independent archiving power, as the information is not relevant from a criminal point of view. For the sake of completeness, it must however be said (based on what has been clarified by the Court of Cassation) that the only exception to this autonomous “trashing” power of the Public Prosecutor is provided for in the case in which the person submitting the complaint expressly requests the investigating magistrate to send the file to the GIP so that he can evaluate the unfoundedness of the crime report (it is therefore not enough to indicate in the complaint that you wish to be notified of a possible dismissal). In short, much ado about nothing.”
