In relation to the changed organization of the organizational macrostructure of the Municipality of Benevento, the former commander of the Municipal Police of Benevento, Fioravante Bosco, intervened and made the following statements:
Fioravante Bosco, Commander of the Municipal Police of Benevento until 01/31/2024, in reference to the resolution of the Benevento municipal council n. 174 of 06/25/2024, relating to the modification of the organisation’s organizational macrostructure, following the ruling of the Court of Benevento – Labor Section – RG n. 1402/2024, acknowledges that the new organizational chart attached to the document no longer makes the municipal police force dependent on an administrative manager, who will instead intervene only for the “Goods and services purchasing office”.
As will be remembered, Bosco had maintained that, within the municipal organisation, the total autonomy of the municipal police force must always be guaranteed, especially with regard to the competences referred to in the art. 9 of law no. 65 of 1986, and it is also for these reasons that the municipal police, especially where established as a Corps, cannot be considered in terms of an intermediate structure (in this case as a Section) of a broader bureaucratic compendium (Administrative Sector) nor, for such incardination, be placed under the administrative manager who is entrusted with the responsibility of this broader structure (TAR Calabria, Reggio Calabria, section I, 22.03.2011, n. 191, Cons. of St., section V, 27.08 .2012, no. 4605; TAR Abruzzo, section I, 30.10.2017, no.
Bosco had added that “the Secretary cannot be the administrative manager of the municipal police force, at most he can provide his collaboration for “purchases and supplies”, working in support of the commander of the municipal police. This is, in essence, the result that was achieved with the two long speeches of former Commander Fioravante Bosco in recent days.
“I am particularly proud of having obtained the result – observes Fioravante Bosco – that I had promised myself on the eve of my interventions. The Municipal Police Force of Benevento remains fully autonomous and dependent only on the Mayor, who is solely responsible by law. I hope that the human resources manager will also be able to benefit from this story. Finally, I intend to thank the Mayor Clemente Mastella and the General Secretary Riccardo Feola for having accepted the legitimate expectations of the municipal police, which needs, in the next two-three years, at least 30 hires to recompose a structure reduced to the gas barrel! ”.
