COSENZA – Doctor Aurora De Ciancio Director of Financial Services of the ASP of Cosenza was acquitted of the crime of abuse of office by the Criminal Court of Cosenza with the formula because the fact does not exist.
And in fact the Bruzio Court, in collegial composition (president Paola Lucente and Ermanna Grossi) fully accepted the defense theses of the lawyer Massimiliano Coppa who dismantled the accusatory theses in detail, demonstrating during a long trial, where numerous witnesses paraded for years, the inconsistency of the prosecution’s theses.
Dr. De Ciancio was brought to trial following the payment of a credit claimed by a private contracted company with the ASP of Cosenza who had appealed for an injunction for a value of €450,000.00 but that the ASP Legal Office directed by the lawyer. Giuseppe Brogno had not opposed allowing the title to become enforceable.
The complaint by the then Extraordinary Commissioner of the ASP of Cosenza Simonetta Bettellini ended up on the table of the Prosecutor of the Republic of Cosenza who opened a file and delegated the Guardia di Finanza for the investigations which, as also indicated by a sentence of the Council of State to which the creditors had turned for payment of the ordered creditindicated that the ASP’s position was undoubtedly more difficult in the absence of opposition to the injunction, confirming the validity of the subsequent acceptance of the compliance judgment solely attributable to the failure to oppose the injunction by the ASP Legal Office which, during the investigations – and absolutely incorrectly (as evidently confirmed with the sentence) through the lawyer Brogno indicated Dr. De Ciancio as responsible for not having sent the documentation in time useful for the technical defense of the institution.

Massimiliano Coppa demonstrated that the accusations made against Dr. De Ciancio were unfounded and that fundamentally the division of competences by subject unfairly placed at the expense of De Ciancio they were only the result of an incorrect evaluation even if coming from the same internal bodies of the ASP. The long years of trial and the unjust status of accused of Dr. Aurora De Ciancio have developed in the same the desire to file a complaint for slander as well as a request for compensation for damages against the ASP of Cosenza and its previous commissioner Dr. Simonetta Bettellini.
