Two entrepreneurs and an accountant stuck in Pesaro

«The carousel has stopped». In Pesaro but, in fact, that’s all made in Salerno. Because the promoter and creator of the fraud against the European Union, Oreste D’Ambrosio, is from Salerno (registered resident in Bellizzi, in fact in Cava de’ Tirreni)as a Salerno native, is the main instigator and participant in the profits of illicit conduct, Raffaele D’Ambrosio – defended by the lawyer Michele Sarno – resident in Pontecagnano Faiano, and the accountant Paolo Lucibello – from Salerno, the capital city – who provided advice and contributed to the drafting of false documentation useful for criminal conduct. There is a fourth suspect: Eduardo Cesar Costo Gallardo, an Argentinian resident in Senigallia, director and sole shareholder of one of the two companies that ended up under the magnifying glass of the financiers from Pesaro, Vendre Più srl. The other company is Tecno Nord Logistica Distribuzioni srl and reported directly to the main suspect, Oreste D’Ambrosio. Three personal precautionary custody orders were carried out on Tuesday, a precautionary disqualification measure against a fourth suspect and preventive seizures against everyone as well as two companies for an amount of 490,198.62 euros. Yesterday the guarantee interrogations before the investigating judge of the Pesaro court during which the suspects answered the questions. The measures have been confirmed and the defense has already announced appeal to the Review. The ordinances and decrees were issued at the request of the‘European Public Prosecutor’s Office (EPPO) of Bologna.

THE ACCUSATIONS

Fifteen cases of fraud were reported to the suspects by the financiers who managed to block illicit requests for public financing provided with the funds of the National Recovery and Resilience Plan for over fifteen million euros that would have been allocated by Simest (company owned by Cassa Depositi e Prestiti). The charges against all are, in various ways, aggravated fraud to obtain public funds to the detriment of the State and the European Union. But also self-laundering, false accounting and embezzlement. According to the accusatory hypothesis, the suspects would have used blank screens of the companies Vendre Più srl, Tecno Nord Logistica Distribuzioni srl and Commerciale Nord Est srl, giving them the appearance of active companies – with the precious collaboration of the accountant Lucibello who took care of the creation of balance sheets and accounting documents relating to activities never carried out in order to obtain financing.

THE INVESTIGATION

The complex activity conducted by the economic-financial police unit of Pesaro, in fact, revealed that these companies directly or indirectly attributable to Oreste D’Ambrosio were in fact non-existent, had totally fictitious headquarters, had no commercial-financial operations and exposed false millionaire turnovers and false operating profits that are always growing. The investigative investigations have brought to light further similar cases of public benefits requested and partly obtained through similar fraud practices in favor of other companies with registered offices in the provinces of Ravenna and Bolzano.

The companies used, in fact, had never submitted the required tax returns, some even for over 20 years, but the suspects took care to create at least two completely false financial statements “on paper” which showed revenues in the millions, depositing them electronically to the Company Register, thus committing the crime of false social communications. They then presented Simest with a series of requests for financing – partly also non-repayable – guaranteed by the State and/or with European funds, motivating them with an alleged desire to internationalize the company, develop electronic commerce or for inclusion in foreign markets.
