The TAR Calabria Catanzaro section with decree of the delegate judge Arturo Levato accepted the urgent precautionary request presented by the lawyer Frank Mario Santacroce for the company Area Srl and ordered the suspension with immediate effect of the activity ban measure ordered against the restaurant Rau’.

The story hit the news following the appeal of the technical director of the venue, Emilio Miriello, who had publicly denounced the persecutory activity of the local city police who, according to Miriello, had harassed the commercial activity with negative, flawed and illegitimate opinions, forcing him to first contact the Catanzaro public prosecutor’s office, filing a complaint against those allegedly responsible for the abuse and then appealing to the administrative judge who immediately accepted the precautionary request, allowing the restaurant to reopen pending the hearing which will be held at the end of July.

Miriello in particular had complained, in the serious silence of the institutions that they have not at all protected a local entrepreneur who, in compliance with the law, guarantees work for over 20 employees and represents a flagship in the city’s catering sector with particular attention to the Neapolitan pizzeria, from which the business originates, and which, the owners claim in the appeal, were denied the possibility of carrying out assisted administration at the tables due to a PS rule on surveillance which would prevent their regular activity when other commercial establishments in the exact same conditions they regularly carry out the activity without problems raised by the authorities and therefore creating a difference in treatment that deserves to be censored because the public body must treat everyone in the exact same way without any distinction whatsoever. So the first round goes to the commercial establishment awaiting judicial follow-up.
