“With great satisfaction we also obtained the precautionary ruling favorable to our theses from the Council of Stateto which the Temporary Grouping d‘Businesses with the Polisportiva dei Fiori 2.3, after the Liguria TAR had rejected at first instance their appeal aimed at canceling the race. The process is not yet finished but we are comforted by the fact that the Ordinance, which decided on the suspension, is motivated in a very detailed way, entering into the merits of the dispute”.
It’s the comment of AC Taggia ASD following a favorable outcome for the request suspension rejected by the Council of State. This is the first step in the appeal phase which should result in the assignment of the Ezio Sclavi pitch to AC Taggia ASD and Sanremese Calcio.
The dispute introduced by Argentina Arma and Polisportiva dei Fiori 2.3 unfortunately prevented the awarding of the contract from proceeding‘plant since last January. Since then, the winning football club has found itself, despite itself, forced to not be able to work towards the rebirth of a football field for which a complex and expensive project had been presented.
Although the Liguria TAR had already rejected the first appeal with a reasoned sentence, the competing group persisted in the litigation, proposing an appeal which was not accepted even in this precautionary phase.
“The decision of the Council of State to reject the request for suspension advanced by the lawyers of Argentina Arma and Polisportiva dei Fiori 2.3 is a further signal that heartens us on an affair that leaves the‘bitter in the mouth – say from AC Taggia ASD – The road is not finished, the appeal to the Council of State still remains active, but we have the hope of being able to resume the path started in a short time, to ensure that the entire community can use a sports facility that today would serve as a‘water to local football”.
“Unfortunately, we all know the conditions Sclavi is in and the timing for reopening it remains uncertain; this is cause for concern becauseAnd the timescales for the necessary works will shorten with the end of management on 31 December 2027. There are many works to be carried out to make the plant usable, with a cost of works that will be difficult to amortize with the original plan presented. Despite this, we hope to offer our children a renovated and efficient structure as soon as possible” – conclude from AC Taggia ASD.
