The Court of Palermo, Judge Dr. Stefania Gallì, acquitted Antonino Pace, defended by the lawyer. Raffaele Delisifrom the serious accusations of having beaten “with punches and slaps and using the dog’s leash and of having threatened the victim several times, even with the use of a knife” during the 15 years of marriage, even accused of inducing her into prostitution offering it to friends and acquaintances.
Pace risked imprisonment of up to 10 years due to the heavy increases in sentences foreseen for the aggravating circumstances complained of.
The offended person, suffering from bipolar II psychiatric disorder, and who had attempted suicide several times in the past, was nevertheless deemed capable of testifying by the consultant psychiatrist appointed by the Public Prosecutor.
However, the defense proved that although the victim was able to testify, her story was not reliable due to the hatred shown towards her ex-husband, also through the production of screenshots of WhatsApp messages containing the promise to “make it end in her husband is sent to prison.”
The defense also demonstrated the generic nature of the victim’s story, who despite having complained of several episodes of aggression over the course of 15 years of marriage, had not been able to produce either a hospital report or a complaint to the police nor to indicate witnesses who had heard or witnessed the facts, however contradicting themselves during his witness examination.
