The court of Naples he recognized the serious responsibilities of the hospital Cardarelliissuing a compensation sentence greater than 400 thousand euros in favor of the patient’s family. The case dates back to about two years ago, when the 50-year-old, following a trivial fall at home, was taken to the Cardarelli hospital in Naples for a femur fracture.
After the surgerywas transferred to a rehabilitation center, but his condition worsened rapidly, forcing him to be admitted to the hospital again Cardarelli. In a short time, the patient manifested severe breathing difficulties, tachycardia and abdominal pain, followed by a progressive deterioration of health conditions.
Medical investigations revealed the presence of multiple and severe infections – Klebsiella Pneumoniae, Acinetobacter Baumannii, Escherichia Coli and Candida Albicans – which caused a serious systemic imbalance, involving the liver and kidneys and ultimately leading to septic shock and death from heart failure.
Represented by lawyers Michele Francesco Sorrentino, Pierlorenzo Catalano and Filippo Castaldo, with the support of the medical examiner Marcello LorelloStudio Maior has filed an appeal for preventive technical assessment (ATP) at the court of Naples.
The experts appointed by the judge confirmed the defense thesis: hospital-acquired infections were the primary cause of death and Cardarelli failed to demonstrate that he had adopted all the hygiene and health measures necessary to prevent such infections. Once the ATP trial was concluded, without settlement agreements on the part of Cardarelli, Studio Maior proceeded with the ordinary appeal. The court, following the first and only hearing, awarded the patient’s family members – brothers and nephews – compensation of over 400 thousand euros for the loss of the parental relationship and further damages.
