The Order of Chartered Accountants and Accounting Experts of Syracuse, after having carefully examined the issue, joins the position taken by other professional categories and expresses its doubts regarding the legislative initiative of the Sicilian Regional Assembly aimed at proposing to Parliament of the Republic to establish the new Court of Modica by downsizing those of Ragusa and Syracuse.

With the “Outline of the bill to be proposed to the Parliament of the Republic pursuant to art. 18 of the Statute of the Sicilian Region, containing “Amendments to the legislative decree 7 September 2012, n. 155 – New organization of ordinary courts and public prosecutor’s offices pursuant to article 1, paragraph 2, of law 14 September 2011, n. 148”, it is intended to remove the municipalities of Noto, Pachino, Portopalo di Capo Passero and Rosolini from the district of the Court of Syracuse, to make them merge into that of Modica. Reorganization operation of the judicial administration which, according to the intentions of the political will that proposes it, should take place through the necessary changes to the staffing plans, but “within the human resources available under current legislation and without new or greater burdens on the budget of the state”.

It is therefore not understood – says the president of the Order of Accountants, Gaetano Ambrogio – what benefit can the administration of justice derive from establishing two nearby courts, Ragusa and Modica, and weakening the Court of Syracuse, reducing the number of magistrates and administrative staff, already particularly lacking today, whose surroundings include, among other things , the largest industrial center in Europe with the associated economic, environmental and labor dispute problems.”

For President Ambrogio, considering the enormous backlog of cases registered in the register regarding employment and family and personal rights, cases which according to the legislator deserve a speedy trial, the bill discussed last March 6th to the ARS aimed at establishing the Court of Modica, weakening the Court of Syracuse, would bring very serious damage to the citizens and to the entire economic system of the provincial community of Syracuse.

Furthermore – goes on -, since each Order is established with reference to the district of a Court, as a category we are concerned about the prospect that the new Order of Chartered Accountants and Accounting Experts of Modica could also be established, which would include colleagues from the municipalities of Modica, Pozzallo, Scicli, Ispica, Noto, Pachino, Porto Palo di Capo Passero and Rosolini. According to this non-recondite hypothesis we will find ourselves with an Order of Accountants whose interlocutors will be the offices of Ragusa and Syracuse, i.e.: Revenue Agency, INPS, INAIL Labor Inspectorate, Customs Agency, SIAE, etc. etc., creating overlaps in operational planning between different Orders. Not to mention the members, who will partly interact with the offices of Ragusa and partly with those of Syracuse, transferring the related problems to the new Order of Modica which will have to deal with them by dealing with the same offices of two different territorial competences and with internal organizations different.”

We would like to be proven wrong – he concludes -, but it would seem that this initiative is not a question of territorial planning of justice, but the price that a part of the Syracuse area pays in not having its own representatives in the Sicilian Regional Assembly. The Syracuse sections of the trade union organizations join the voice of the Order of Accountants: the National Association of Accountants, the National Union of Young Chartered Accountants and Accounting Experts, the Italian Association of Chartered Accountants.”
