In Catania theAssociation of Italian matrimonial lawyers will hold the conference “Family relations in their evolution: critical issues of pre-trial reforms” tomorrow 14 June. The theme of the meeting is the future of the specialized court for families: the objective is to write a common document to be forwarded to the competent authorities of politics and justice

The topics to be discussed

The conference which will take place at Palace Catania – Una experiences in via Etnea 218 will be chaired by the lawyer Gian Ettore Gassani. The central theme will be the Cartabia reform in family relations law. Furthermore, the issue of the “Family Court” which is expected to be launched will be explored in greater detail, as contemplated by the Cartabia reform.

Matrimonial lawyers ask for broad guarantees on the organization of judicial offices responsible for protecting the rights of families and minors. The Cartabia reform, according to them, did not provide suitable financing for the family sector.

The reasons for the conference

At present, there are 3 thousand magistrates and 4 thousand chancellors missing from the workforce. Of these 3 thousand magistrates, at least 500 should be responsible for dealing with family law. The majority of bloody events occur within broken families or unhealthy couples.

Therefore the emergency of feminicides and family violence also derives from the slowness of family procedures. The Institutional Lawyer believes that, to offer greater guarantees to the fragile subjects of family relationships and to prevent violent events within the home, Courts that are up to the situation are needed, which guarantee the right to be heard and the adoption of measures immediate. Unfortunately, at present, the Cartabia reform has not entirely succeeded in improving the family and juvenile justice system. In Catania, lawyers and magistrates will discuss these issues, to draw up a common document to be forwarded to the competent political and justice authorities.

The requests

These are some of the requests and proposals that will be discussed:

1) Approximately 3,000 magistrates are missing from the organic structure. This leads to continued appeal

to honorary justice, made up of non-professional magistrates.

2) There is a lack of stationery staff. The telematic process cannot solve it alone

issues that have been dragging on for years regarding the organization of chancelleries and

Magistrates’ secretariats.

3) The honorary judges of the psychological area will have to be employed differently and

in any case not in the decision-making phase of the procedures. It’s much closer to the right

process the use of office technical consultants for the respect of the cross-examination in

topical phases of the procedures.

4) The specialization of magistrates must be concrete and verifiable in each district

territory of the country.

5) Provision of assisted negotiation procedures in family matters of free

patronage paid by the State in order to also guarantee more economically disadvantaged groups

weak.

Speeches during the conference

The event, which will be moderated by Paolo Corsini, Director of Rai’s in-depth programmes, will open with speeches by the Prefect of Catania Dr. Maria Carmela Librizzi, the President of the Court of Appeal of Catania Filippo Pennisi, the Mayor of Catania Enrico Trantino and Dr. Franbcesco Mannini, President of the Court of Catania. The conference will be followed in live streaming by thousands of lawyers online.
