The fifth criminal section of the Supreme Court of Cassation, accepting the appeal of the cassation lawyer Dario Vannetiello and the lawyer Luigi Senese, has the life sentence was annulled issued on 11 January 2024 by the Court of Assizes of Appeal of Naples – against Davide Francesconebelieved to be involved, among other things, in the murder of an innocent victim of the Camorra, Antonio Landieri.

Francescone was also criticized five attempted murders committed against Antonio Mangiacapra, Salvatore Engheben, Mauro Magiacapra, Vincenzo Trombetta and Giovanni De Rosa. Landieri, after whom a stadium in Scampia is named today, was killed on 6 November 2004 during a Camorra raid.

The first degree sentence for Francescone was issued on 4 October 2018, the second degree sentence on 8 September 2021, judgments on the merits which also saw the leaders of the clan that ordered the ambush convicted, including the splinter bosses Raffaele Amato Cesare Pagano.

On 8 February 2023, the Supreme Court, first criminal section, accepted only the appeal brought by Davide Francescone, ordering a new trial limited to the aggravating the recurrencebefore another section of the Court of Appeal of Naples. The judges of Naples again confirmed the life sentence. Last night the Capitoline judges annulled the life sentence for the second time by ordering the third appeal trial.
