Municipality of Terni, new off-balance sheet debt of 18 thousand euros for an accident

From 19 July 2016, the day of the accident, to June 2024. Almost eight years after the event, the Municipality of Terni is preparing to recognize another substantial off-balance sheet debt due to an accident: the draft settlement agreement is ready with a write-off of 30 % to close the game. For the institution it is worth an economic outlay of almost 18 thousand euros.

In essence, as has already happened several times in recent years, the legitimacy of off-balance sheet debt is recognised. The Municipality was in fact condemned to pay compensation for pecuniary and non-pecuniary damage, in addition to the additional burden of interest, revaluation and litigation costs. The Court of Appeal of Perugia then confirmed the first degree sentence and the problem arose. The position – we read in the preliminary document prepared by the institutional affairs manager Cataldo Renato Bernocco – fell “within the jurisdiction of the bankruptcy, however the same was not included among those for which the OSL, with the resolution of 10 January 2024, ordered the provision for the ongoing litigation, despite different indications on the matter from the civic attorney’s office”.

There is therefore an amicable agreement with a saving of 30% compared to what was imposed by the 2023 sentence. The sum at stake is 16,260 euros plus various expenses in favor of the Revenue-Collection Agency for tax on sentences and the unified contribution. In total, the outlay for the Municipality amounts to 17,957 euros with use of the provision for litigation risks with budget changes. A copy of the resolution, once approved by the city council, will be sent to the prosecutor’s office of the Court of Auditors.
