TOanother blow to the boss of Foggia, Roberto Sinesi, 62 year old head of Sinesi-Francavilla clan, known as “Lo uncle” or “Capacchione”, a nickname that was not very popular with the mafioso.
After the arrest on May 14th for the attempted murder of Vito Bruno Lanza, the Court of Cassation rejected his lawyer’s request for the release of his client. The Supreme Court has instead the appeal of the Bari general prosecutor’s office was accepted canceling with postponement the provision of the Court of Appeal which in February he released Sinesi from prison for around 24 hours. The boss, in fact, was only briefly reunited with his loved ones and then returned to his cell due to the appeal of the prosecutor. Previously he was in Rebibbia, also at 41 bis, now in Oristano prison. The annulment with postponement means that the Court of Appeal will have to re-examine the position of the mafia boss.
The issue revolves around the recalculation of the sentence. For the defense there is a continuation between the crimes committed in the 1990s and those committed between 2015 and 2018 because Sinesi would have continuously played a top role in the dynamics of the “Foggia Society”. For this reason the sentence would have been recalculated at 22 years and 7 months, largely served by the boss. The prosecutor’s office is of the opposite opinion and deems it impossible to recognize the continuation after approximately twenty years. “The decision to give Sinesi 19 years of imprisonment deserves censure and must be annulled.”
At the moment “Lo Uncle” is serving 26 years for three final sentences imposed in the trials “Saturn” and “Tenth Action” and in the trial for possession of a weapon with which he returned fire in the ambush against him on 6 September 2016 when he was injured together with his nephew. End of sentence around 2040.
But the release would have been virtual only: as mentioned, Sinesi was issued a new precautionary order on May 14th. The boss is accused of having instigated the attempted murder of Vito Bruno Lanza known as “U’ Lepre”, a leading exponent of the Moretti clan. Lanza escaped death on 17 October 2015, during the mafia war between Foggia clans. They have already been definitively convicted for this affair Luigi Biscotti and Ciro Spinelli. Now the alleged instigator (Sinesi) and the alleged driver of the armed commando, the associate, have also been arrested Sergio Ragno.
