He was acquitted of sexual assault Giovanni Favia, former exponent of the 5 Star Movement and now manager of some clubs in Bologna. This was decided by the preliminary hearing judge of the Court of Bologna Roberta Malavasi, at the end of the abbreviated trial, which took place this morning. The investigation started from the complaint of a girl, assisted by the lawyer Barbara Iannuccelli, with whom Favia had had a relationship. The disputed event dates back to the night between 5 and 6 November 2021.

It was the prosecutor who requested the indictment of the former M5s member in January Tommaso Pierini, after the investigating judge Domenico Truppa had ordered the forced indictment in June. Initially the prosecutor had asked for the dismissal, but the woman’s lawyer had opposed it, so Truppa had ordered the compulsory indictment for the crime of sexual violence, instead ordering the dismissal for the charges of stalking and injuries. Favia, assisted by the lawyer Francesco Antonio Maisano, has always defended himself by claiming that he was spuriously reported by the woman following the end of their relationship. Then came the acquittal.

“Justice has been done”

“Finally the innocence of Giovanni Favia, unjustly accused of a hateful crime, has been written in indelible letters and with the broadest of acquittal formulas”, says the defender, the lawyer Francesco Antonio Maisano. “After years of judicial ordeal, accompanied by a real ‘media butcher’, today the final word has finally been written – he continues -. In a time in which too often people talk about the ‘presumption of innocence’ without actually practicing it, I hope that at least this case remains emblematic of what can happen even to an innocent person. I only wish my client to recover for everything he has had to lose, unjustly, in recent years, from health to social consideration. It will be difficult but I wish him everything Heart”. For the lawyer Barbara Iannuccelli, who assists the woman who reported Favia, “in this complex and tortuous judicial process we have a prosecutor who requests the dismissal, a judge who, following our opposition, imposes the formulation of the charge for sexual violence, considering the evidence to be present, and a judge who then acquits. We are destabilized. We await the reasons in 90 days.”
