These are the words used in the reasons for the sentence of the Court of Assizes, presided over by the judge Fiorella Casadei, who last January 29th sentenced to 24 years and 2 months in prison, Maximo Aldana De La Cruz, defended by the lawyer Paola Benfenati of the Bologna Court.

On May 22, 2022, when the agents of the Rimini Flying Squad arrived in the apartment in via Dario Campana, the 55-year-old confessed to the murder of his ex-partner, Noelia Rodriguez. And the Court of Assizes itself leaves no doubt about the reconstruction of the facts. Despite the immediate confession and collaboration of the accused, the deputy prosecutors Davide Ercolani and Stefano Celli they had asked for a life sentence for voluntary manslaughter.

Even according to the judges of the Assizes, Aldana was aware that the last meeting with the victim for whom the accused had bought the engagement ring “would not have been at all favorable to him – we read in the sentence – due to the continuous and repeated, constant attitudes of detachment that Rodriguez had shown him, to the point of making him aware of a possible new relationship undertaken, so that the delivery of the ring represented more of a pretext than a real opportunity”.

According to the judges, therefore, she had clearly said “no”but he had not wanted to understand “so much as to suppress that rebellion with the elimination of the irreducible person himself”.
