COSENZA – Once again the Cosenza Hospital Trust has been condemned to a maxi compensation for the death of a little girl happened for confirmed hospital infection but although the sentence has become final, the hospital does not pay, forcing the family to notify the foreclosure. Despite the certainty of responsibility ascertained by the experts of the Court of Cosenzathe Hospital Company does not pay the compensation, forcing the family members, assisted by the lawyer Massimiliano Coppa – an expert in medical negligence – once again, to notify the seizure as has already happened for other sentences which, unfortunately, the Hospital – although regularly covered by insurance policy for which he paid an annual premium of approximately three million euros – does not intend to pay.
This further twist in the story evokes the pain of his premature death of the little girl and leaves no words regarding the conduct engaged in by the hospital administration given that the sentence has been definitive for over 90 days and can no longer be challenged in order to review the terms of liability.
The enforcement procedure undertaken by the girl’s family will result in further costs and interest on the sums paid by the Bruzio Court and no longer contestable considering that the failure to comply committed by the Hospital – definitively condemned – and which intended pay only the sum of 100 thousand euros in the face of a sum six times higher, it is no longer debatable in any court of merit. This case too, already dealt with by the Court of Cosenza, has now reached the table of the Enforcement Judge of the Bruzio Court whose hearing is set for July 26, 2024 to whom the family of the little girl were forced to turn to execute the sentence which awarded them a large sum as compensation plus legal interest for over 6 yearseven if this further piece guarantees the execution of the sentence but inevitably evokes an immense pain never calmed by the unjust death of the little girl.
