Historic ruling in the context of the equality between victims of duty and victims of terrorism obtained byLawyer Enrico Tedeschi of the Tedeschi Military Law Firm with which the CONAPO is affiliated.
This is the result of long and laborious work that the Tedeschi studio has carried out, over time, with rigor and great determination.
The Ministry of the Interior, in fact, has always denied, at least until today, even for victims of duty, the application of the benefits that the law recognizes to surviving family members of terrorism victims with a disability equal to 50%.
L’Lawyer Tedeschi communicated that: “the Court of Avellino, with a sentence dated 09/19/2023, which became final, also recognized the family members of one of our clients (victim of duty) the right to obtain a lifetime allowance of €1,033 .00 per month subject to automatic equalization, provided for by art. 1, paragraph 494, law 147/2013 with effect from 1.1.2014. The legal battle I conducted has finally put an end to an injustice that deserved to be cancelled, attributing the benefit and rejecting the adverse deductions of the Ministry. The decree issued by the Ministry and published by us is clear proof of this, despite the skeptics and those who doubted that this sentence led to the drafting of the relevant decree. Another imposing wall, on the road to definitive equality between the various categories of beneficiaries, was today finally demolished in the interest of all those who risk their lives every day in the service of the State”.
