(Teleborsa) – Victory for Assoutenti on the subject of Super bonus and “ghost” jobs. The Court of Treviso, accepting the appeal brought following the association’s campaign, condemned the Agm Group srl company with registered office in Conegliano (Tv) arcash in on consumers involved who had joined the legal action.
The story began in 2021, when numerous citizens of Veneto and Friuli turned to Assoutenti reporting non-compliance by the Agm Group company, general contractors who in terms of Superbonus were responsible for conducting and optimizing all phases of the building interventions – explains the association – Although the customers had paid the initial fees (from 500 to 1,500 euros each) the company did not start the works, the practices remained blocked and construction sites did not start, without any response from the company, despite the many requests from the users involved. The documents collected after consumer complaints showed how the company – even just to save time – did so limited to providing a feasibility study that was often erroneous and unusable. Furthermore, many consumers have paid a sum of money for the feasibility check and technical expertise, but have not yet obtained reimbursement for the work (due to the failure to carry it out). For these reasons Assoutenti had initiated legal action before the Court of Treviso.
Today the Court’s decision arrives, with a sentence that fully accepts Assoutenti’s theses and condemns the Agm Group company to reimburse approximately 50 citizens represented by the association. We read in the motivation of the sentence: “the termination of the contracts signed by the appellants with AGM GROUP SRL and the latter must be ordered to repay the sums received”
The lawyers Alessia Favaro and Antonio Rosetta who followed the case on behalf of Assoutenti comment: “The Judge recognized the systematic non-compliance by AGM Group, reiterating the importance of respecting contractual obligations. We are proud to have contributed to this result, which constitutes an important precedent also for other cases connected to the 110% Superbonus”.
