The dl 76-2024 for reconstruction and major eventswhich arrived in the Official Journal on 11 June, introduces a series of provisions in response to needs that emerged during the implementation of civil protection and post-disaster reconstruction interventions and measures relating to the holding of major international events, such as the G7 in Brindisi and the Milan-Cortina Olympic Games.

The provision also includes: aid for areas affected by floods starting from May, which concern both compensation for damage to movable property and the possibility of using the aid already provided for the reconstruction of immovable property to purchase new building areas or new buildings.

Flood contributions, the news

The first two articles of the decree-law approved on 10 June by the Council of Ministers are dedicated to benefits in favor of private entities damaged by flood events.

The provision provides that the Extraordinary Commissioner for Reconstruction can grant, within the spending limit of 210 million euros, contributions to private individuals not carrying out social, economic and productive activities who have suffered damage to movable propertydestroyed or seriously damaged as a result of the flood events that occurred in the month of May 2023 in the territories of the regions Emilia-Romagna, Tuscany and Marche.

The relief refers to assets present within properties owned by private entities intended for residential use and is granted in the form of flat-rate contributions based on the number and type of rooms in the buildings in which these goods were located. The maximum threshold established by the decree is equal to 6 thousand euros homewith a maximum amount of 3,200 euros for furnishings and appliances that were located in a kitchen and 700 euros for each of the other rooms.

The legislative decree also provides that, within the scope of contributions for the private reconstruction of properties damaged by floods, in the case of buildings that cannot be reconstructed, alternatively the benefits can be used to reimburse up to 100% of the expenses necessary for:

  • the purchase of alternative areasalready identified by the urban planning tools, where it is necessary to provide for the partial or total relocation of seriously damaged buildings for which it is not possible to carry out reconstruction in the same place;
  • the purchase of properties immediately available for residential or productive use in the municipalities where the damaged property is locatedin the event that the property is seriously damaged and reconstruction in the same place cannot be carried out.

The land areas of buildings demolished or to be demolished for which relocation measures are arranged are acquired free of charge from the available assets of the Municipality.

To speed up the procedures granting and disbursement of contributions for private reconstructionthe decree also provides that the extraordinary commissioner – whose mandate is extended to 31 December 2024 – can make use of, in addition to his own structure, also public bodies and state bodies to carry out checks on the interventions for which contributions have been granted for reconstruction.

Finally, the legislative decree extends the coverage of contributions for the restoration of structures and infrastructurespublic and private, damaged, as well as damage suffered by economic and productive activities to private assets and economic and productive activities, also with reference to the calamitous events that occurred in 2022-2023 for which a state of national emergency has been declared and “for which funding under primary law has not already been provided”.
