The fatal accident on the construction site and the simulation of the road accident to hide the fall from the roof of the undeclared worker: ten years after the events the crimes are mostly barred. However, manslaughter still stands, for which the prosecutor’s office has requested 3 sentences of 4 years and 6 months in prison each.

According to the public prosecutor Gaspare Bentivegna, three of the five defendants are guilty of causing the death of Giuseppe Gioacchino Bordonaro, 52 years old.

Under accusation Maria Grazia Cuva, 60 years old, Antonio Ferraro, 63 years old, Roberto Lauricella Donisi, 55 years old, Giovanni Garlisi, 44 years old, and Gioacchino Caracciolo, 48 years old, all from Canicattì, the city where the incident occurred.

According to the prosecutor’s magistrate, Lauricella Donisi should be sentenced as owner of the company entrusted with the works; Ferraro, considered the owner and client of the works and Garlisi, owner of the executing company.

For Cuva, also accused of manslaughter with the same position as Ferraro, acquittal was proposed.

Worker dies on construction site, defendant asks for plea deal

In Cuva, Ferraro, Lauricella Donisi and Garlisi, some violations of workplace safety regulations relating, among other things, to the failure to prepare scaffolding were also reported. Garlisi, who in fact is also responsible for simulating a crime, would have tried to hide the episode by telling the doctors at the Barone Lombardo hospital in Canicattì that he had hit Bordonaro who was on the road collecting weeds with his van. He charges which, however, according to the prosecutor, are no longer punishable because the statute of limitations has expired.

The accident occurred in the Montagna-via Forlì district on 24 June 2014. Bordonaro was transferred to Messina hospital where he died on 16 July. According to the prosecution, the defendants would have caused the death of Bordonaro, “who was not regularly employed as a worker”, who, working “without the necessary safety measures in the ceiling of the building under construction, lost his balance and fell”.

Worker fell from roof: 5 indictments

Caracciolo, the victim’s colleague, is accused of aiding and abetting because he allegedly denied Bordonaro’s presence on the construction site: this crime hypothesis is also time-barred. They were all accused of illegal construction because the building would not have had any licence, but the amnesty eliminated the crime.

The proceedings, currently in the home stretch before judge Michele Dubini, have been adjourned to June 26 for the start of the defense arguments by lawyers Daniela Posante, Dino Milazzo, Giuseppe Giardina and Giovanni Salvaggio.
