Student excluded from Erasmus project, TAR condemns school

TERAMO, 13 MAY – Penalized in the competition for the “Erasmus +” project because she will not continue her studies at the institute she already attends. It happened to a student of the primary school of the “Zippilli-Noé Lucidi” comprehensive institute in Teramo who saw the possibility of carrying out a period of study abroad disappear due to a scoring criterion not previously specified by the school in the notice to join the selection. The institute’s behavior was condemned by the TAR. The student’s family, in fact, presented an appeal to the Administrative Court of L’Aquila, through the lawyers Lorenzo De Gregoriis and Emiliano Mario Laraia, to ask for the annulment of the ranking relating to the part in which ten points were awarded for “the scholastic continuity”. This criterion, which referred to the desire to continue the educational path within the “Zippilli-Noé Lucidi” comprehensive institute, did not provide for the attribution of points in the application for participation in the competition. The student, together with other classmates, participated in the written and oral test, obtaining the maximum score and coming first in the ranking. However, the school, in indicating the final ranking, awarded ten more points to students who had expressed the desire to continue their studies in the same comprehensive institution. The candidate thus slipped from first to fourth place and was excluded from the “Erasmus +” project which would have allowed her to stay in Greece in June to improve her English language. Hence the appeal to the TAR which ended with the condemnation of the school and the annulment of the documents in the part in which the ten points for “school continuity” were awarded. For the lawyer De Gregoriis “this is an important sentence that stigmatizes the actions of the school administration, which has not shown evidence of acting in compliance with the canons of impartiality and transparency of administrative action, moreover to the detriment of a little girl”.
