Former manager appears in the Municipality on the day of the arrest: ‘suspension’ confirmed on appeal

The Labor section of the Court of Appeal of Naples confirms the suspension for six months, with non-payment of salary, against the former municipal manager of Marcianise Gennaro Spasiano.

The court, chaired by Mariavittoria Papa, rejected the appeal of Spasiano who had challenged the previous verdict issued by the judges of Santa Maria Capua Vetere who had confirmed the disciplinary sanction adopted by the Municipality, represented in court by the lawyer Massimiliano De Benedictis, whose theses were fully accepted in the two degrees. The provision was also confirmed on appeal with Spasiano who was sentenced to pay the legal costs.

The basis of the complaint by the organization is a false attestation of his presence in the workplace. From what has emerged, in fact, the former manager would have been at work (the time clocked in at 8.03) on the same day he was arrested, at 6 in the morning, by the financial police for the Interporto affair. The former manager has always defended himself by claiming that that clocking in was the result of an error in the attendance management system.
