PALERMO – Sentence overturned. The death of the little brothers Carmelo and Laura Mulone, aged 9 and 7, in the Maccalube nature reserve in Aragona remains without culprits. The Court of Appeal of Palermo acquitted the then director of the reserve Domenico Fontana and former president of Legambiente (he had 6 years in first instance) and the operator of the reserve Daniele Gucciardo (5 years and 3 months in first instance).

The acquittal of the regional official confirmed, Francesco Gendusa (assisted by lawyers Pasquale Contorno, Giuseppe Immordino and Nicolò Grillo), but the formula changes: no longer because the act does not constitute a crime, but because it was not committed. Same formula also extended to the other defendants, defended by lawyers Vincenzo Lo Re, Giulio Vasaturo and Daniele Ciancimino. No civil liability on the part of Legambiente, assisted by lawyers Fausto Amato and Marco Manno

Passes the defensive line according to which, it was elsewhere that we had to look to ascertain responsibility of the immense tragedy, following the indications of the experts. The latter brought into play the Civil Protection of the Municipality of Aragon.

It was September 27, 2014, the little brothers were overwhelmed by a wave of mud while they were taking a walk with their father. The sentence to pay damages is also dropped. The two convicted on the basis of the first instance sentence of the Court of Agrigento, jointly and severally with Legambiente, would have had to compensate the parents of the poor children with an amount close to two million euros.
