Milan, 7 February 2023 – Dinner with boyfriend in a vegan restaurant in the Garibaldi area. The sudden illness and hospitalization for one anaphylactic shock. There died after ten days in a coma. The Milan Public Prosecutor’s Office has opened a file with the hypothetical crimes of manslaughter, fraud in the exercise of trade and the sale of non-genuine foodstuffs on the death of the 20-year-old AB, which took place last night at the San Raffaele.
The investigation is focusing on the dishes that the girl ordered that night and specifically on a tiramisu jar with possible traces of dairy products, a food to which she was hyperallergenic and which should not have been present in a 100% vegan establishment. At the moment, there are four people registered in the register of suspects, as communicated by the chief prosecutor Marcello Viola: they are the owner of the company that produces the sweet, the production manager and two employees.
Prosecutor Luca Gaglio immediately ordered the administrative detention of the seven jars of Tiramisun – Vegan tiramisu present in the shop, while yesterday the Ministry of Health gave the order to withdraw from the market (from 63 shops throughout Italy, to be exact) the batch of the product with the Mascherpa tiramisù brand and expiry date of 23 July 2023. Reason for the recall: “Presence of allergen: milk proteins”. Warning: “Product that may contain traces of dairy products, consumers are advised not to consume the product and to return it to the point of sale for a refund”.
The Ats technicians and the Nas carabinieri have already inspected the laboratory of Glg srl of Assago where the dessert is produced (with a connected sales point in Milan), and, as far as it appears, irregularities have emerged correlated to the risk of contamination of the dish classified as vegan. The samples taken both from the “Tiramisun” eaten by the girl and from those found in the laboratory (95 jars in all) were sent to the Zooprophylactic Institute of Brescia, which will analyze them to see if they contain traces of dairy products.
Let’s go back to January 26th. AB and her boyfriend have dinner in a restaurant they know well, specialized in serving food without ingredients of animal origin and already frequented by the young couple in the past. At the end of the meal, the twenty-year-old ordered a jar of «Tiramisun» (which still yesterday appeared on the restaurant’s menu available on the web): she is sure she can eat it, there is no trace of dairy products on the label, for which she an allergic hypersensitivity. After a few teaspoons of sweet, the girl feels sick and loses consciousness. She triggers the call to help: the Areu doctors transport the twenty-year-old to the emergency room of the San Raffaele, but she anaphylactic shock generated by a substance he could not ingest it will prove fatal after about ten days in a coma. In the meantime, the Public Prosecutor’s Office is launching an investigation to understand what caused the illness: initially we think of some damaged product, but the investigators’ checks do not find any anomalies. It is the family members of the 20-year-old who inform the investigators of the allergies; and at that point the preliminary qualitative analyzes by the Nas specialists bring out the hypothesis of the presence of milk proteins in «Tiramisun». Hence the seizure of the seven jars and the provision of the Ministry of Health on the entire lot to avoid other similar cases. It is not enough. Yes, because, again according to what appears at the moment, AB she was also allergic to eggs, the presence of which would have been intercepted by the analyzes in a mayonnaise used to flavor a hamburger that the girl would always eat that evening, before the Tiramisun. Therefore, the next tests will have to clarify this aspect as well, investigating a possible contamination and possible links with the death. The autopsy on the 20-year-old’s body should be carried out between Thursday and Friday. In addition, the prosecutor will entrust an expert with allergy advice.
